We’ve seen countless arguments from the pro NRA people (I’m deliberately mentioning the NRA because there are lots of gun owners who don’t support the statements/policies of the NRA) about why there should be no further firearms legislation. I’m going to address some of the more widely used arguments.

Disclaimer: When I use the term “Assault Weapon” (AW) in this article I’m talking in general about high velocity firearms with high capacity magazines.

They’re going to ban all guns!

Nobody is talking about banning all guns. What is being discussed right now is more (and better) regulation, especially when it comes to AW’s and background checks.

Regulation does not equal ban.

They’re going to take away all my guns!

Probably not. If, and this is a big “if”, the legislators decide on a ban on AW’s the current owners of these firearms will most likely be grandfathered in (as in, you get to keep the AW’s you already have).

If they do decide to “round up” all AW’s in the country, you’ll still get to keep your other guns.

Waaaaah 2nd Amendment waaaaah!

Again, you will still be allowed to bear arms, but the sale and distribution of these arms will just be better regulated. Remember, the word “regulated” is in this amendment as well as the “right to bear arms”.

Second Amendment

I’m a hunter, I need my guns for hunting.

By all means, keep hunting. It’s a hobby for many people. And you don’t need AW’s for hunting.

I’ve been a gun owner for years, and I keep them safe away from my kids.

Good, then you’re one of the responsible gun owners. Sadly, not everyone is like you. And you still don’t need AW’s.

Criminals don’t follow the law so banning AW’s will give them an advantage and cause more deaths.

There will always be a black market, that is correct. However, the black market is supplied via the legal market, and if you limit the flow of AW’s to the legal market, fewer AW’s will enter the black market.

If it’s very difficult and complicated to obtain an AW on the legal market, the possibility of such weapons entering the black market will be very very small.

Also, I don’t think I’ve ever heard of a burglar carrying an AW while burgling. He will be much more interested in carrying loot, so you will still be able to defend yourself against these culprits.

Civilians with concealed carry permits will be able to stop mass shooters.

First, this has not been proven. On the contrary, evidence seems to point towards this having no or a very small effect.

Second, these civilians will still be able to carry their concealed guns.

Third, this is about AW’s. Try concealing an AW.

Fourth, if you have civilians attacking mass shooters with AW’s themselves, chances are that even more innocent people will get hit and die.

I need my guns to protect myself against the government/police.

The government has way bigger guns than you do, so if it comes to that, no amount of AW’s is going to save you.

As for the police: Abide the law and they won’t come for you.

The Founding Fathers gave us this right so we have the power to overthrow a tyrant/dictator.

You live in a democratic country. Your president is elected legally and democratically. He is not a tyrant, nor a dictator. He is elected by the people according to US laws.

If you don’t like how the laws work, try to change them in a legal way. Be politically active, join a political party, run for office, round up likeminded people.

If you don’t get enough people to join your cause, or enough votes for you to change those laws you don’t like, then you have to live with it because that’s how democracy works. If you still don’t like it, then I suggest you emigrate to another country more to your liking.

As for you wanting to use your guns to overthrow the government, you might want to familiarize yourself with US law (18 U.S.C. § 2384):

“If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined or imprisoned not more than 20 years, or both.”

So, think again before you take up arms against your democratically elected government.

We just need to put armed guards where shootings can occur.

Then you will need to put armed guards literally everywhere because mass shooters can decide to do their killing spree where ever they like.

But this is not coming up with a solution, this is not even damage control.

To quote the fabulous David Bowie: This is “putting out fire with gasoline”.

The President has armed bodyguards, they carry guns!

Yes, and you nailed it yourself: They’re bodyguards. They’re members of The United States Secret Service, and their job is to protect the President of the United States. They are not civilians.

When you’ve received the same amount of death threats that the President has, then I might agree that you, too, can have armed bodyguards.

Ban cars! They kill people, too!

Again, we’re not talking about a ban, we’re talking about regulation, and cars are plenty regulated, where AW’s are pretty much non-regulated.

If there weren’t drivers license requirements, speed limits, safety belt regulations etc., I can promise you that cars would cause a lot more deaths each year.

Your argument is invalid.

Kitchen knives, baseball bats, bottles can kill too!

Can you cut vegetables with an AW? Carry water in it for drinking? Killing is not the primary design intent of these items.

How many people can be killed in 5 minutes by kitchen knives, baseball bats, bottles, compared to deaths by AW’s?

The design intent for AW’s is to fling bullets at people at extremely high speed, and that’s the ONLY thing it is designed for.

Again, your argument is invalid.

Alcohol and drugs kill, too!

Drugs and alcohol are heavily regulated.

Also, indulging in these intoxicants is a choice you make for you. You’re doing it to yourself, not to other people.

Apples and oranges.

It’s video games and violent movies that causes people to do mass shootings! Ban those!

Take a look at the rest of the world. Everyone watches the same movies as you do, everyone plays the same games as you do, and yet you’re the only country with a “mass shooting problem” this big.

In countries with strict gun legislation the “mass shooting problem” is almost non-existant, so your argument doesn’t hold water.

What about the people dying from drones? Shouldn’t we worry about them?

Yes, and people do worry about them.

However, drones aren’t AW’s in the hands of civilians, and we’re not discussing how the weaponry of the USA is being used in foreign countries. We’re discussing a domestic problem.

Again, you’re comparing apples and oranges.

We shouldn’t ban guns, we should focus on mental health issues instead.

You should regulate guns, especially AW’s, and at the same time focus more on mental health issues.

Ignoring one part on the problem while focusing solely on another part won’t fix anything. A solution needs to deal with every aspect of the problem, not just a tiny part.

But Background checks will mean that I’m registered in an archive that the government can use to keep track on me!

Do you have a car? Driver’s license? Then you’re already registered.

It makes perfect sense to have a nationwide gun register in order to track weapons used in crimes. If you’re not selling your firearms to shady people, then you have nothing to worry about.

Besides, thorough background checks will make it even harder for criminals to get a hold of guns, and I’m sure you want that access restrained, right?

Guns don’t kill people, people kill people!

Almost correct. People with guns kill people, bullets kill people, and people with high velocity firearms and high capacity magazines kill LOTS of people in a very short time, and THAT is what this is all about.

I live in a country where we have very strict gun laws.

We watch the same movies as you do in the United States, and furthermore, we don’t censor or beep out anything here, so we’re even more exposed to “bad stuff” than you are.

We have the same video games that you do, and people play them just as much.

So, we’re very much alike in that way, except when it comes to gun violence. Every single time there is a shooting – even by a police officer – it makes the national news, and we’ve never had a “mass shooting”.

I’m fully aware that our model won’t work for the USA because your gun culture is so integrated, but this should give you all something to think about.
